1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you and Estate Atlas ("Estate Atlas", "we", "us", "our") governing your access to and use of our global real estate intelligence platform, including our website, dashboard, applications, data, and related services (the "Platform").
By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy, Cookies Policy, and Data Disclaimer, which are incorporated by reference. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. The Platform is intended for professional, business, and institutional use. If you use the Platform on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.
3. Accounts
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. We strongly recommend enabling two-factor authentication. Notify us promptly at [email protected] of any unauthorized use. You may not share, sell, or transfer your account, and access is licensed per user unless your plan expressly permits more.
4. Subscriptions, billing, and renewal
- Plans and fees: Access is provided on a subscription basis. The current plans, features, and fees are those shown at checkout.
- Billing: Payments are processed by our payment partner, Stripe. By subscribing, you authorize us to charge your chosen payment method the applicable fees, plus any taxes.
- Automatic renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price, unless you cancel before the renewal date. We will provide any renewal or price-change notices required by law.
- Price changes: We may change our fees. We will give you reasonable advance notice, and changes apply from your next billing period.
- No free trial: Estate Atlas does not offer free trials. Access begins once your subscription is active.
5. Cancellations and refunds
You can cancel your subscription at any time from your account settings. Cancel stops the next charge. Access continues until the paid period ends.
For 14 days from purchase, on both monthly and yearly plans, you can ask for a refund. If access has already started, the refund is the unused days only, not the whole charge. After 14 days there is no change-of-mind refund.
Checkout asks you to request access immediately. For digital content, once access starts you lose the 14-day right to cancel the contract for a full refund. Inside those 14 days, the unused-days refund above still applies. This does not limit a refund where the service itself failed.
Your statutory rights: Nothing in this section limits or excludes any rights or remedies you have under mandatory consumer protection laws that apply to you, including the Australian Consumer Law and consumer-withdrawal rights under EU and UK law. Where such laws give you a refund or other right that this policy does not, that law prevails.
6. License to use the Platform and the data
Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its data for your internal business and investment-research purposes.
You may not, and may not allow others to:
- copy, scrape, harvest, crawl, mine, or extract data from the Platform by automated means except through any API we expressly provide and under its terms;
- resell, redistribute, sublicense, publish, or make the data available to any third party, or create a competing or derivative product or dataset;
- reverse engineer, interfere with, or attempt to gain unauthorized access to the Platform or its security;
- remove proprietary notices, or misrepresent the source of the data; or
- use the Platform unlawfully or to infringe the rights of others.
Data scraping and automated extraction are strictly prohibited. The data, compilations, analyses, and content on the Platform are our proprietary property and are protected by intellectual property and database rights. Any attempt to scrape, crawl, spider, harvest, mine, copy, or otherwise extract data from the Platform by automated or systematic means, except through an API we expressly authorize and in accordance with its terms, is a serious breach of these Terms and may also infringe our intellectual property and database rights and violate applicable computer-misuse and data-protection laws. We monitor for unauthorized extraction. Where we detect it, we may immediately suspend or terminate your access without notice, and we reserve the right to pursue all available legal and equitable remedies against you, including seeking injunctive relief and recovering damages, account profits, and our legal costs, to the fullest extent permitted by law.
7. Intellectual property
The Platform, its software, design, and all data, compilations, analyses, charts, and content we provide are owned by us or our licensors and are protected by intellectual property laws. Except for the license in Section 6, no rights are granted to you. Feedback you provide may be used by us without obligation to you.
8. Data accuracy and no investment advice
Our data is aggregated from official and third-party sources and is provided for informational purposes only. Real estate markets are dynamic and data may be incomplete, delayed, or inaccurate. The Platform does not provide financial, investment, legal, tax, or other professional advice, and nothing on it should be relied on as such. You are responsible for your own due diligence and decisions. Full detail is in our Data Disclaimer, which forms part of these Terms.
9. Acceptable use and suspension
You agree to use the Platform lawfully and in line with these Terms. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Platform, other users, or our rights. Where we terminate without cause, we will refund any prepaid fees for the unused portion of your term.
10. Service availability
We work to keep the Platform available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and we may perform maintenance that temporarily limits access.
11. Disclaimers
To the maximum extent permitted by law, the Platform and all data are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions, including Australia, do not allow the exclusion of certain guarantees; in those jurisdictions, our liability is limited as set out in Section 12 to the extent permitted, and your mandatory statutory rights are not affected.
12. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or investment losses, arising from your use of or inability to use the Platform or its data; and
- our total aggregate liability arising out of or relating to these Terms or the Platform will not exceed the greater of the total fees you paid us in the 12 months before the event giving rise to the claim, or AUD 100.
Where the Australian Consumer Law or other mandatory law applies and a guarantee cannot be excluded, our liability is limited, where permitted, to resupplying the service or paying the cost of resupply.
13. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform or its data, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law rules. You and we submit to the exclusive jurisdiction of the courts of New South Wales, Australia, except that either party may seek injunctive relief in any court of competent jurisdiction. Mandatory consumer protections in your country of residence are not affected by this clause.
15. Changes to these terms
We may update these Terms from time to time. We will post the updated Terms here and update the "Last updated" date, and for material changes we will provide more prominent notice. Continued use after changes take effect means you accept the updated Terms.
16. General
These Terms are the entire agreement between you and us regarding the Platform. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
